A bill that removes the criminal penalties for marijuana possessionreplacing the prospect of jail-time for a small amount with a $125 ticketwas, on May 21, passed through the state Senate and will go to Gov. Bruce Rauner for his signature or veto.
HB 218 provides a statewide standard for cannabis possession, with a maximum $125 fine for possession of 15 grams or less, and automatic expungement upon fine payment, according to a press release from the office of state Rep. Kelly Cassidy, who sponsored the bill in the House, where it passed 62-53 April 23. The bill also implements scientifically proven standards for driving under the influence of cannabis and strengthens penalties for the production of butane extracts.
According to the legislation, the law would mean a decrease of 115 correctional inmates, and a savings of $29.3 million, over the first 10 years of the bill's implementation.
"This legislation ensures equal enforcement statewide and ensures that charges for small amounts of cannabis do not ruin someone's life, creating barriers against housing, employment and education," said Cassidy in the statement.
The measure passed the Senate 37-19. It was sponsored there by state Sen. Michael Noland.
