Child Protection Case Pending

Controversial gay activist Marc Loveless faces a child protection case against him stemming from an incident in April of 2002.

The Cook County State's Attorney filed a motion in May of 2002 alleging Loveless had beaten his adoptive son Nathan with a whiffle ball bat. As a result, Nathan, now 12, is out of Loveless's care and in the custody of the Department of Children and Family Services.

A parallel criminal case against Loveless stemming from the same incident had to be dropped in August of last year when a witness did not show in court. Tom Stanton, a spokesman for the State's Attorney's Office, said the juvenile division is handling the case now as an additional avenue to deal with the allegations—to at least deal with the issue of custodial rights.

A hearing date is set for Sept. 15 to examine the status of the case.

There is no bail in a non-criminal case, but Loveless is not allowed to have custody of his son Nathan. There are periodic status hearings, according Stanton, to determine custody issues.
